Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and OriginalGuard (“OriginalGuard”) governing your access to and use of the OriginalGuardapps, website and services (the “Service”). Please read them carefully.
1. Acceptance of these Terms
By creating an account, accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms. If you do not agree, do not use the Service.
2. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised use at development@originalguard.com.
3. Workspaces & roles
The Service is organised into organisation workspaces (“Workspaces”). Workspace administrators invite and manage members (such as supervisors and guards), configure operations, and control the operational data within their Workspace. If you join a Workspace operated by your employer, your use may also be subject to your employer's policies. We are not responsible for the decisions a Workspace makes about its members or data.
4. Acceptable use
You agree to use the Service lawfully and in line with our Acceptable Use Policy. You must not misuse, disrupt, reverse-engineer, or attempt to gain unauthorised access to the Service or its data.
5. Subscriptions, fees & billing
Paid plans are billed to the Workspace on a subscription basis at the prices and intervals shown at purchase. Unless stated otherwise, fees are exclusive of applicable taxes and are non-refundable except where required by law. Subscriptions renew automatically until cancelled. Failure to pay may result in suspension or downgrade of the Service.
6. Intellectual property
The Service, including its software, design, branding and content, is owned by OriginalGuard and its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose. You retain ownership of the content and data you submit (“Your Content”), and grant us the rights needed to operate and provide the Service.
7. Your data
Our handling of personal data is described in the Privacy Policy. You are responsible for ensuring you have the rights and consents needed for the data you submit, including data about other people in your Workspace.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that location and tracking features will be perfectly accurate. The Service is a tool to assist operations and is not a substitute for professional security judgement or emergency services.
9. Limitation of liability
To the maximum extent permitted by law, OriginalGuard and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts paid by your Workspace to us for the Service in the twelve months preceding the event giving rise to the claim.
10. Suspension & termination
You may stop using the Service at any time and may delete your account (see Account Deletion). We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or for prolonged non-payment. On termination, the licence granted to you ends; sections that by their nature should survive (including IP, disclaimers, liability and governing law) will survive.
11. Governing law & disputes
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Subject to applicable law, the courts at [Registered business address] (or as otherwise specified in our order documents) will have exclusive jurisdiction over disputes arising from these Terms. Nothing here limits any mandatory consumer rights you may have under local law.
12. Changes to the Service or Terms
We may modify the Service or these Terms from time to time. Material changes to the Terms will be notified in-app or by email. Continued use after changes take effect constitutes acceptance of the updated Terms.
